At Daniels Legal, we believe that clients receive the best service when they use a law firm that focuses specifically on the area of law that they need help with – rather than broadly across many areas of law. For us, that is litigation.
Litigation is not a well understood area of law but, in short, it means disputes. Litigators spend more time in court and resolving disputes than most other types of lawyers. We’re not the ones that draft contracts, prepare wills or help you buy a house. We’re the ones that fight for you when things go wrong – or help you avoid things going wrong if they start going down the wrong path.

At Daniels Legal, we believe that when dealing with a dispute, you can’t just focus on the tip of the iceberg – you have to know what is hidden below. What is below is not always obvious and requires a full understanding of who you are, what your circumstances are and what your goals are - not just a brief understanding of your current legal problem. Franchise Disputes

We help franchisors and franchisees with franchise disputes. We can review your franchise agreement and provide advice as well as assist you with resolving and litigating franchise disputes if you are issued a Notice of Dispute or a claim.

Property Disputes

We help lessors and lessees with lease disputes (such as unpaid rent, property damage and more), owners and builders with house and land disputes and owners and claimants with all property disputes relating to residential and commercial property (including disputes between family members and friends who own property together – regardless of whether the ownership is formal or in writing).

Contract Disputes

We help parties to contracts resolve contract disputes where there are unfair contract terms, breach of contract and additional agreements made that were never formalised.

Many people believe that ‘contracts’ need to be in writing and signed. They do not. If you made an agreement with someone and they aren’t holding up their end, we can help.

Trust and Equitable Disputes

Does something feel unfair or wrong but you don’t think you have a legal basis to stand up for yourself? It probably is wrong and you might have a claim in equity.

There used to be a separate court of ‘equity’ (which, simply put, means ‘court of fairness’) for Judges to hear disputes between people where there was some perceived unfairness (even though there was no contract) and, although there is no separate court for it anymore, the laws still exist.

For example, you may not have an interest in a property but it may be held for you on an ‘resulting trust’ or ‘constructive trust’ without you even knowing it. So, if it feels wrong, it probably is, and we can probably help.

We also help with disputes relating to formal trusts – unit trusts, discretionary trusts and more.

Body Corporate Disputes

We help body corporates, managers and owners with body corporate disputes including pet disputes (is the dog allowed in the property?), levy disputes, improper conduct by members and managers and more.

Professional Negligence Disputes

We help individuals and businesses make claims against professionals and businesses who have been negligent and caused the individual or business to suffer loss. Claims can be made against anyone who owes a duty of care.

Obvious categories are accountants, doctors, real estate agents and lawyers – yes, even lawyers – as a firm with a focus on high standards, we love taking other lawyers to task to ensure the profession’s reputation is not tarnished by reckless conduct.

People worry about calling lawyers to make claims against other lawyers, but we assure you that any query (even informal ones) are kept completely confidential and we will fight just as hard for you as we would in a claim against anyone else.

Our Legal Practitioner Director, Jess, is a lawyer with a difference.

Having worked as a litigator since 2015, she loves to help her clients resolve problems in a logical way that suit their personal needs.

Whether that’s fighting for justice in the courtroom or negotiating outcomes that help clients avoid the courtroom, she has your back.

In the past, Jess has worked on a vast array of litigious matters from simple disputes that can be resolved quickly and cost-effectively to complex and lengthy disputes that require a true dedication to the client and the matter to achieve optimal results.

Jess is known for her unique problem-solving solutions that can sit a little outside of the usual legal box. This is due to her experience in business having owned and worked in businesses in a variety of industries prior to becoming a lawyer.

Unlike many lawyers, Jess has also been a client in a litigation matter that has spanned across approximately 6 years so knows firsthand how stressful and emotionally tolling it can be to experience litigation as a client. This gives her a unique ability to empathise with her clients and know what they need and want in a lawyer.

With Jess on your side, you can expect to receive high level legal expertise, unique strategies, empathy and humour.

Philip Ciniglio

Consulting General Manager

Our General Manager, Phil, is not your average GM of a law firm.

With over 30 years of business and management experience including one of his most recent roles in the UK as CEO of an international brand, it’s fair to say Phil knows his way around a business.

Highlights of Phil’s career include developing over 40 franchise systems for well-known Australian and International brands, acting as an Accredited Mediator in over 80 mediations, sitting on a variety of boards and advising the Premier of Queensland as a member of the ‘Small Business Advisory Committee’.

In addition, Phil has been associated with the Franchise Council of Australia for over 20 years and is a past President of the Queensland Chapter and Director on the National Board. He was also honoured to win the ‘Contribution to Franchising Australia’ award in 2012.

Phil uses his experience and expertise to help Jess ensure that Daniels Legal delivers top quality legal services for businesses and seamless management from within.
